SB-331 prevents non-disclosure agreements (NDAs) and confidentiality clauses from hiding any type of harassment and discrimination in the workplace. Non-disclosure agreements (NDAs) have faced criticism for shielding companies from public accusations of wrongdoing.

This law targets NDAs that prevent employees from speaking about workplace harassment and discrimination. The new law also expands a ban on broad confidentiality and non-disparagement clauses that employees have to sign.

This new employment law, SB 331, goes into effect on January 1st, 2022. Employers need to review their separation agreements and termination templates.
